Gaytan, Hernandez cases.

NOTE- Those of you who have followed the site for a while realize that I ‘get mad’ [every so often] on video.
For many years [20?] I heard lots of stories from guys on the streets- about cops. To be honest- I thought they were lying.
Because lots of the stuff- planting evidence- targeting people- beating guys up [not during arrests- but simply mugging them] sounded- if you will ‘too good- or bad- to be true’.
Then I realized the guys were not lying.
That’s what ‘set me off’.
As a firefighter- who also was a supervisor- for 25 years- we also had firefighters who were ‘not good’- meaning they abused injury leave- maybe lied about how long it took to get to the fire.
I realized- at one point- that the supervisors- of CCPD- knew some officers were doing ‘bad stuff’- and they apologized to the guys that bad stuff was done to [supervisors saying ‘we promise he will never do it again’].
And yet- the cop did do it again.
So- from my perspective- I saw that it was a real problem- that the Chief- or other supervisors- could not stop.
But they should have fired the cop- or at least disciplined the guy.
That’s what set me off.
I personally emailed Chief Simpson – before he died- saying ‘I think there’s a problem with a cop here in the Bluff- just wanted to give you a heads up’.
Ok- I’m sure Chief Simpson spoke to the cop.
About a week later the cop tried to run me off the Oso Bridge!
Look- I don’t play ‘that game’ and that’s why you have seen me ‘go off’ at times.
This past week we have had a couple of police videos go ‘viral’- one was an officer throwing a football with some kids https://ccpdblotter.files.wordpress.com/2013/05/ccpd-football-buc-parade.jpg  at Cole park- it was fine- good.
Then we had one of an officer playing hoops with some kids http://www.kztv10.com/story/31968644/ccpd-officer-plays-basketball-with-a-group-of-kids - good- I liked that- nothing wrong with it.
Police depts. across the country feel like they are ‘under siege’- that’s a fact.
Now- why the link to the cop who killed himself?
The MAIN problem is the reality that civilian police departments- while the majority of the cops are indeed good men- the departments themselves are unable to deal with criminal activity- being committed by on duty officers.
That’s the real problem- that’s why you have seen me blog on this stuff.
That’s what I want you to see on the article of the officer- and sadly- his wife- who both committed suicide because he was being investigated.
The many videos we have seen the last few years [Slager- etc.] show that many of the unjustified killings were covered up- at the highest level [Chicago- Mayor Rahm Emmanuel- etc.]
It’s not that every cop is corrupt- corruption is in the hiding of criminal acts- by the departments themselves.
In many of the shootings- the other officers all lied on the reports- until video surfaced.
The problem is the departments are unable to ‘police’ themselves.
Sometimes it’s because of union protections- political reasons that the average citizen has no idea is going on.
Many Black people have complained for years about this- and they were right- the majority of the time.
So- I’m glad the CCPD is doing the community outreach stuff- that’s good.
But the problem is- many departments are unable to deal with their own men- and that’s what you see in the above link.

Those of you who have watched the videos know I thought this kid was ‘framed’ from the start.
I watched the trial when it happened- and this was the case where another kid- facing court himself- blurted out ‘they want me to frame Gaytan’ – as unbelievable as this sounds- this happened.
It was reported in our local paper at the time.
Then- as I watched the case- during trial it came out that both the car-and the gun- were not the car- and gun- that were used in the killing.
Yet- I found it amazing that a jury still convicted him.
Just a couple of weeks ago this case has been sent back to the DA- by a higher court- basically saying ‘what in the hell are you doing down there!’
The Caller Times article showed how the cops got the key witness to lie.
As I thought about what happened here- I’m gonna put the best ‘spin’ on it- best meaning I’ll give the CCPD and DA the benefit of the doubt.
I think they were obviously under pressure to solve the case- and during their investigation others told them that Gaytan was out that night- had a gun- etc. which just so happened to be true.
At that point- the cops/DA must have thought ‘yup- it’s him’.
That’s probably why they told the key witness ‘we know who it is- we need you to I.D. him’.
Now- I’m sure the cops/DA realized as they investigated the case- that both the gun- and the car Gaytan used- were not the ones used at the crime.
Then why go ahead and try him?
At that point they already convinced Valent to- quote- ID him.
And it would look bad to ‘turn back now’.
But that’s what they should have done- they sent this kid to life in prison- with false evidence.
They knew- at least at the time of the conviction- and they still did it.
Now- that’s corruption- pure and simple.
And in our city- I commend the Caller times- and local media for revealing this stuff.
The problem has reached a tipping point- and I believe the Feds need to come in- and do something
UPDATE- I just read a news story ‘Hernandez gets 5 years’ probation- for shooting at local cops’.
Last year the cops were called to a scene- a man firing a gun.
Hernandez claimed he did not know the people he shot at were cops [maybe so?]
The prosecutors wanted to charge him with attempted murder of a peace officer- which could have been a life sentence.
The jury convicted him of a lesser charge- and took 7 minutes [SEVEN] to give him probation.
The prosecutors had no comment.
Why did this happen?
Over the past 5 years there have been untold stories- in the media- of prosecutorial misconduct- cases getting overturned- doctors saying the DA has lied about their testimony.
Prosecutors admitting they did wrong- coming out in public and admitting they broke the law [Hannah Overton case- medical examiner in Hayden case- and witnesses in Gaytan case- etc.]- on and on.
I think this shocking outcome- probation- might be a sort of O.J. verdict.
Where many have seen other ‘rigged’ convictions- and used this case to send a message.
Obviously- 7 minutes to give probation to someone who shot at cops- is problematic.
I never advocate for people- who actually shoot at cops- to get probation.
But the public has seen all that you have seen me talk about- and said ‘we have had enough’.

Judges 6:1 And the children of Israel did evil in the sight of the LORD: and the LORD delivered them into the hand of Midian seven years.
Judges 6:2 And the hand of Midian prevailed against Israel: and because of the Midianites the children of Israel made them the dens which are in the mountains, and caves, and strong holds.
Judges 6:3 And so it was, when Israel had sown, that the Midianites came up, and the Amalekites, and the children of the east, even they came up against them;
Judges 6:4 And they encamped against them, and destroyed the increase of the earth, till thou come unto Gaza, and left no sustenance for Israel, neither sheep, nor ox, nor ass.

Judges 6:12 And the angel of the LORD appeared unto him, and said unto him, The LORD is with thee, thou mighty man of valour.
Judges 6:13 And Gideon said unto him, Oh my Lord, if the LORD be with us, why then is all this befallen us? and where be all his miracles which our fathers told us of, saying, Did not the LORD bring us up from Egypt? but now the LORD hath forsaken us, and delivered us into the hands of the Midianites.
Judges 6:14 And the LORD looked upon him, and said, Go in this thy might, and thou shalt save Israel from the hand of the Midianites: have not I sent thee?
Judges 6:15 And he said unto him, Oh my Lord, wherewith shall I save Israel? behold, my family is poor in Manasseh, and I am the least in my father's house.
Judges 6:16 And the LORD said unto him, Surely I will be with thee, and thou shalt smite the Midianites as one man.
Judges 6:17 And he said unto him, If now I have found grace in thy sight, then shew me a sign that thou talkest with me.
Judges 6:18 Depart not hence, I pray thee, until I come unto thee, and bring forth my present, and set it before thee. And he said, I will tarry until thou come again.
Judges 6:19 And Gideon went in, and made ready a kid, and unleavened cakes of an ephah of flour: the flesh he put in a basket, and he put the broth in a pot, and brought it out unto him under the oak, and presented it.
Judges 6:20 And the angel of God said unto him, Take the flesh and the unleavened cakes, and lay them upon this rock, and pour out the broth. And he did so.
Judges 6:21 Then the angel of the LORD put forth the end of the staff that was in his hand, and touched the flesh and the unleavened cakes; and there rose up fire out of the rock, and consumed the flesh and the unleavened cakes. Then the angel of the LORD departed out of his sight.
Judges 6:22 And when Gideon perceived that he was an angel of the LORD, Gideon said, Alas, O LORD God! for because I have seen an angel of the LORD face to face.
Judges 6:23 And the LORD said unto him, Peace be unto thee; fear not: thou shalt not die.
Judges 6:24 Then Gideon built an altar there unto the LORD, and called it Jehovahshalom: unto this day it is yet in Ophrah of the Abiezrites.
Judges 6:25 And it came to pass the same night, that the LORD said unto him, Take thy father's young bullock, even the second bullock of seven years old, and throw down the altar of Baal that thy father hath, and cut down the grove that is by it:
Judges 6:26 And build an altar unto the LORD thy God upon the top of this rock, in the ordered place, and take the second bullock, and offer a burnt sacrifice with the wood of the grove which thou shalt cut down.
Judges 6:27 Then Gideon took ten men of his servants, and did as the LORD had said unto him: and so it was, because he feared his father's household, and the men of the city, that he could not do it by day, that he did it by night.
Judges 6:28 And when the men of the city arose early in the morning, behold, the altar of Baal was cast down, and the grove was cut down that was by it, and the second bullock was offered upon the altar that was built.
Judges 6:29 And they said one to another, Who hath done this thing? And when they enquired and asked, they said, Gideon the son of Joash hath done this thing.
Judges 6:30 Then the men of the city said unto Joash, Bring out thy son, that he may die: because he hath cast down the altar of Baal, and because he hath cut down the grove that was by it.
Judges 6:31 And Joash said unto all that stood against him, Will ye plead for Baal? will ye save him? he that will plead for him, let him be put to death whilst it is yet morning: if he be a god, let him plead for himself, because one hath cast down his altar.
Judges 6:32 Therefore on that day he called him Jerubbaal, saying, Let Baal plead against him, because he hath thrown down his altar.
Judges 6:33 Then all the Midianites and the Amalekites and the children of the east were gathered together, and went over, and pitched in the valley of Jezreel.
Judges 6:34 But the Spirit of the LORD came upon Gideon, and he blew a trumpet; and Abiezer was gathered after him.
Judges 6:35 And he sent messengers throughout all Manasseh; who also was gathered after him: and he sent messengers unto Asher, and unto Zebulun, and unto Naphtali; and they came up to meet them.
Judges 6:36 And Gideon said unto God, If thou wilt save Israel by mine hand, as thou hast said,
Judges 6:37 Behold, I will put a fleece of wool in the floor; and if the dew be on the fleece only, and it be dry upon all the earth beside, then shall I know that thou wilt save Israel by mine hand, as thou hast said.
Judges 6:38 And it was so: for he rose up early on the morrow, and thrust the fleece together, and wringed the dew out of the fleece, a bowl full of water.
Judges 6:39 And Gideon said unto God, Let not thine anger be hot against me, and I will speak but this once: let me prove, I pray thee, but this once with the fleece; let it now be dry only upon the fleece, and upon all the ground let there be dew.
Judges 6:40 And God did so that night: for it was dry upon the fleece only, and there was dew on all the ground.
12 He said therefore, A certain nobleman went into a far country to receive for himself a kingdom, and to return.
13 And he called his ten servants, and delivered them ten pounds, and said unto them, Occupy till I come.
14 But his citizens hated him, and sent a message after him, saying, We will not have this man to reign over us.
15 And it came to pass, that when he was returned, having received the kingdom, then he commanded these servants to be called unto him, to whom he had given the money, that he might know how much every man had gained by trading.
16 Then came the first, saying, Lord, thy pound hath gained ten pounds.
17 And he said unto him, Well, thou good servant: because thou hast been faithful in a very little, have thou authority over ten cities.
18 And the second came, saying, Lord, thy pound hath gained five pounds.
19 And he said likewise to him, Be thou also over five cities.
20 And another came, saying, Lord, behold, here is thy pound, which I have kept laid up in a napkin:
21 For I feared thee, because thou art an austere man: thou takest up that thou layedst not down, and reapest that thou didst not sow.
22 And he saith unto him, Out of thine own mouth will I judge thee, thou wicked servant. Thou knewest that I was an austere man, taking up that I laid not down, and reaping that I did not sow:
23 Wherefore then gavest not thou my money into the bank, that at my coming I might have required mine own with usury?
24 And he said unto them that stood by, Take from him the pound, and give it to him that hath ten pounds.
25 (And they said unto him, Lord, he hath ten pounds.)
26 For I say unto you, That unto every one which hath shall be given; and from him that hath not, even that he hath shall be taken away from him.
27 But those mine enemies, which would not that I should reign over them, bring hither, and slay them before me.
